Expanding your Amazon business into the French market is a powerful growth strategy. However, the moment your inventory lands in a French fulfillment center, you become subject to the French Value Added Tax (VAT) system, known as TVA (Taxe sur la Valeur Ajoutée). Understanding your TVA obligations is essential for legal compliance and long-term success.
The Trigger for French TVA Registration
The rule is straightforward and absolute for FBA sellers: storing goods in France creates a legal requirement to register for French TVA.
- FBA is a Taxable Presence: When you send your products to an Amazon warehouse in LIL1, ORY4, or any other French FC, you are physically holding stock in the country. This act alone triggers the need for a French TVA number, regardless of your sales volume.
- Pan-European FBA: If you are enrolled in the Pan-EU FBA program, Amazon has the right to move your stock to a French warehouse to be closer to customers. Therefore, participation in this program mandates that you have a valid French TVA number.
Understanding Your TVA Obligations
Once you are registered, you have two main responsibilities:
- Collect TVA on Sales: You must configure your Amazon Seller Central account with your French TVA number. Amazon will then automatically add the correct TVA rate (the standard rate is 20%) to your selling price on all orders shipped from France or to French customers.
- File Regular TVA Returns: You or your appointed tax agent must file periodic TVA returns with the French tax authorities. In these returns, you declare the total TVA you have collected from customers. You can also reclaim the TVA you paid on your business expenses in France (such as on Amazon's fees or import TVA).
Important: The EU's One-Stop-Shop (OSS) system simplifies reporting for cross-border sales if you do not store goods in the destination country. It does not replace the need for a standard TVA registration in France if you use FBA there.
